PRIVACY STATEMENT HAPPY GROUP B.V.

Happy Group B.V. is an organisation that organises multiple events (the ‘EVENTS’), including, but not limited to, Happy Feelings, NMNH, Vrienden Van, FLEX werken, Circular and Cirque du Zoleip, (‘Happy Group B.V.’), which is located at Veemarkt 212F, 1019 DG in Amsterdam and registered with the Chamber of Commerce under number 76727300. If you register for one of the events organised by Happy Group B.V., the personal data you provide will be managed under the responsibility of Happy Group B.V..

Careful handling of your personal data is of great importance to Happy Group B.V. Personal data is therefore carefully processed and secured. In doing so, we comply with the laws and regulations in the field of personal data protection, as laid down in the General Data Protection Regulation (‘GDPR’).

Responsible for the processing of personal data

Happy Group B.V. is responsible for the processing of your personal data under the names of the various EVENTS, which you provide to Happy Group B.V. by purchasing a ticket for the event or via the website www.happygroup.nl or underlying websites per concept (the ‘Website’) or in any other way.

This means that Happy Group B.V. determines the purposes and means of the processing itself and is responsible for compliance with the legal requirements set out in the GDPR.

Purposes of personal data processing

When you visit the Website, request information via the Website, purchase a ticket from EVENTS and/or register with Happy Group B.V. via the Website, we will record your personal data. Happy Group B.V. only processes the personal data necessary for the purposes listed below.

Your personal data is required for the following purposes:

  • to be able to provide you with the ticket you purchased;

  • to identify you at our Festival;

  • verify your age (only 18+ are welcome)

  • conduct target group analyses for the purpose of logistics regulations for events;

  • contact you to inform you about EVENTS;

  • send you a message by SMS for marketing purposes

  • to inform you about other events organised by Happy Group B.V.

In addition, Happy Group B.V. uses your personal data for promotional activities such as:

  • Sending out newsletters;
  • Personalised online advertising on social media channels such as Facebook, Instagram, Snapchat, Vero and WhatsApp.

  • Personalised online advertising via Google using banners and search engine optimisation;

  • visitor surveys.

The personal data that we (may) record about you are the following:

  • First name + last name

  • Email address

  • Telephone number

  • Gender

  • Address and place of residence

  • Date of birth

  • Telephone number

If you register on the Website, your personal data can only be accessed by Happy Group B.V. or by a processor engaged by Happy Group B.V. (see further under “exchange of personal data”). We will not disclose your personal data to others without your consent, unless we are required to do so by law or court order, or if this is necessary for the performance of an agreement between you and Happy Group B.V..

If you do not wish to receive information about EVENTS or Happy Group B.V., you can unsubscribe using the unsubscribe button in the newsletters or service emails you receive. You can also send an email to info@happygroup.nl.

Third parties

Your personal data may be shared with third parties. We do this because:

  • we have engaged them to support us;

  • that is necessary to perform the agreement with you (such as for events that we organise together with third parties);

  • we have a legitimate interest in doing so; or

  • we are legally obliged to do so (for example, if the police demand it in the event of a suspected crime).

The following third parties may process your personal data at our request:

  • Our ICT service providers;

  • Online and offline postal and shipping services (such as for our newsletter and your tickets);

  • Payment service providers;

  • Cookie service providers;

  • Partners (parties that organise events together with us);

  • Our partner for ticket orders (YourTicketProvider);

  • Our partner for marketing tools (Boest B.V.);

  • Photographers and filmmakers (who are present at our events);

  • Other entities within our group (for administrative purposes or advertising via cookies if you have given your consent);

We have made agreements with all of the above parties regarding the careful handling of your data. Where necessary, we will always ask for your permission before sharing data with third parties.

Legal grounds for the processing of personal data

According to current and new legislation, Happy Group B.V. may only process personal data if one of the legal bases applies. Happy Group B.V. applies the following legal bases for the processing of personal data:

  • in the context of the conclusion and/or execution of an agreement. By registering on the Website, you explicitly consent to the processing of your personal data for the purposes described above;

  • to comply with the law (including accounting requirements, tax obligations and obligations under court orders or other mandatory laws and regulations);

  • in connection with the legitimate interests of Happy Group B.V., whereby Happy Group B.V. ensures that the impact on your privacy is as limited as possible. For example, personal data is processed in connection with:

    • conducting studies, creating models, compiling statistics, identifying trends and developments;

    • maintaining and improving the Website, whereby Happy Group B.V. can determine your (click) behaviour when you visit our Website in order to provide you with targeted information (profiling). The logic used by Happy Group B.V. is that your IP address is linked to your actions and your preferences are determined on that basis. We always ask for your explicit consent in advance (see below under Website and Cookies).

Website and Cookies

The website tracks visitor data such as the pages most frequently requested by visitors. The purpose of this is to optimise the layout of the website. This data can also be used to place relevant information on the pages you visit, such as special messages in your areas of interest or special promotions (from advertisers). In this way, our services to you can be further optimised.

Exchange of personal data

1. Transferring and receiving personal data within Happy Group B.V.:

Happy Group B.V. may use your (personal) data to promote various events organised by Happy Group B.V. Happy Group B.V. ensures that the European standards of the GDPR are applied with regard to these exchanges. You can unsubscribe from such messages at any time.

2. Transferring and receiving data outside Happy Group B.V.:

The purpose of processing your personal data may involve Happy Group B.V. sharing personal data with other organisations. Insofar as there is no explicit consent or legal obligation, this exchange of data will only take place on the basis of the execution of the agreement between Happy Group B.V. and this third party, whereby an adequate processing agreement has been concluded that meets the requirements of the GDPR, or when Happy Group B.V. has a legitimate interest in doing so.

3. No commercial use:

Happy Group B.V. will not sell, rent, distribute or otherwise make your personal data commercially available to third parties, except as described in this privacy statement or unless you have given your prior consent.

Accuracy of the personal data provided

By registering on the Website with your personal data, you guarantee that this data is accurate and complete. Happy Group B.V. may temporarily or permanently deny you access to the website or parts thereof, as well as access to events, if you provide false identities or incomplete or incorrect data.

Storage of personal data

Happy Group B.V. does not retain personal data for longer than two years unless longer retention is necessary for the purposes for which the data is processed and in any case for as long as specific regulations require.

Your privacy rights

You have the right to access your personal data, the right to request correction, restriction or deletion of your personal data, and you can also request the transfer of your data. Finally, you can object to the use of your data. If the processing of your data is based on consent, you can withdraw this consent at any time.
